USDA Proposed Rule: ADU Income on Single Family Guaranteed Loans

Important: This article describes a proposed rule, not enforceable USDA policy as of July 2026. Current HB-1-3555 eligibility and income rules still govern guaranteed files until USDA publishes a final rule.
On March 31, 2026, USDA published Document Number 2026-06173 (Docket RHS-26-SFH-0100): Single Family Housing Guaranteed Loan Program: Income-Producing Accessory Dwelling Units. The comment period closed June 1, 2026.
What USDA is proposing
The rule would permit income-producing accessory dwelling units (ADUs) on properties financed with Section 502 guaranteed loans when:
- The ADU is legally permitted and meets local zoning
- Rental income from the ADU can be documented and considered in qualifying under proposed underwriting standards
- The property remains eligible as a single-family dwelling with an ADU, not a multi-family investment property
USDA cites housing supply and accessory-income use cases as policy goals. Specific income calculation, appraisal, and occupancy requirements would appear in final handbook or administrative notice text.
What brokers should do now
- Underwrite to current handbook for ADU and rental income treatment until final rule language is effective.
- Track lender overlays; many investors already restrict ADU rental income on USDA even if USDA liberalizes.
- Document zoning and permit status early on files with ADUs; final rule is likely to require legal compliance.
Why this matters if finalized
Rural and suburban purchase files with granny flats, garage conversions, or detached ADUs could gain a USDA path when rental income helps DTI, subject to final income and property eligibility rules. Until then, assume no USDA guarantee on income-producing ADU scenarios your lender does not already allow under today's policy.
